When a truck gets into an accident with another vehicle there are usually more deaths and critical injuries. Because of this, there are more federal and state rules to prevent semi truck accidents. For example, because driver fatigue is a serious problem, there is a specific federal rule outlining how many hours a truck driver can be on the road. This is called the hours of service regulation (49 CFR Part 395).
When our law firm gets a case, we look at whether driver fatigue was a factor in the accident. We also look at whether the semi truck driver was distracted and whether that distraction caused the accident.
A frequent cause of distracted driving is texting. It is one thing for the driver of a car to text while driving. It is completely another thing for a semi truck driver to text while driving.
Recently in Minnesota, there was a a tragic collision on Interstate 94, a busy freeway. A perfectly responsible driver saw that there was a fire on the side of the road and slowed down. What we do when we get a case is demand an inspection of the vehicle. We go through the semi truck and download information from the onboard computer. From this and other information, we can usually analyze what happened in the collision and prove whose fault it was.
