Fuel Truck Accident Prompts Wrongful Death Lawsuit
A fuel truck accident wrongful death lawsuit will not be tried a second time, according to an Olmsted County, Minnesota district judge. Attorneys for the plaintiff–the family of the deceased–requested a second trial based on juror misconduct but the motion was denied.
The accident, which happened in August 2008 on Minnesota’s Interstate 90, killed a 19-year-old man from Winona, Minn., after his car rear-ended a Midwest Industrial Fuels truck. In the resulting truck accident lawsuit in April 2010, lawyers for the family of the deceased contended that the driver of the fuel truck was negligent in several ways, citing the driver’s illegal U-turn from the east to westbound lanes of the highway, failure to turn on the truck’s flasher lights, failure to merge into the right lane as soon as possible, and failure to signal the lane change when he did merge into the right lane. It was found by the jury that both drivers were at fault.
